URĀ Membership Agreement

In Ibiza, 4 July 2026. General terms of contract, membership and use of the facilities of CLAP HOUSE (trade name), BUILD ACTIVITY SL (company name). The Spanish version is the authoritative contract; this English text is a translation for your understanding.

01Declarations

1. The Club is a sports and wellness facility offering members access to and use of its facilities, guided activities, sports services and complementary services, under the terms of this document and the rates or particular conditions accepted by the User.

2. The User applies to join as a member and declares they know and accept these general terms, the rules of use and operation, the current rates and, where applicable, the particular conditions of the contracted membership.

3. The User declares they are in adequate health to practise physical activity, without prejudice to their obligation to inform the Club of any injury, illness, condition, allergy, medical contraindication or circumstance that may prevent, condition or limit such practice.

4. Where the User is a minor, contracting and use of the facilities are subject to authorisation by their parents, guardians or legal representatives, and to the specific age restrictions for each area or activity.

02Contracting and Membership

1. Becoming a member. Membership is acquired by completing registration, accepting these conditions and paying the first applicable fee under the current rate.

2. Personal and non-transferable. Membership and any card, wristband or access code are personal and non-transferable; the User may not transfer, lend or allow their use by third parties. Breach may result in definitive termination, without prejudice to amounts owed.

3. Contracted membership. Access is limited to the fee tier contracted and its included services. Services not included may be contracted separately at current rates.

4. Payment of fees. Membership requires being up to date with fees, optional services, rentals, penalties and any other amount owed. Not using the facilities does not exempt payment for the contracted period.

5. Method of payment. Periodic fees are paid by direct debit, card, cash or another accepted method; for direct debit the User authorises the Club to charge the corresponding receipts.

6. Returned receipts. If a receipt is returned for reasons attributable to the User, they bear the applicable return and handling costs, without prejudice to the outstanding amount.

7. Non-payment. Non-payment entitles the Club to temporarily suspend access; if it persists after demand or the stated deadline, the Club may cancel membership, claim outstanding amounts and refuse new contracts until the debt is fully settled.

8. Membership updates. The Club may update fees, rates and prices, including the annual CPI update or other objective criteria, and modify fees on substantial changes to services or membership, with reasonable prior notice.

9. Change of fee or membership. Requests for changes must be notified in writing before the 20th/24th of the month prior to the effective one; late requests take effect the following period, unless expressly accepted.

10. Additional products/services. Membership does not prevent separately contracting products, services, special activities, personal training, rentals, guest passes or others, paid at the current rate.

03Access, Hours and General Use

11. Access. To enter you must identify yourself with the card, wristband, app, code or access system set by the Club, and present it whenever staff request it.

12. Loss or misuse of the access means may incur a replacement cost, penalty or handling fee per the current rate.

13. Right of admission and capacity. The Club reserves the right of admission and use for legal, safety, health, capacity, coexistence, proper-operation or breach reasons; access to each area/activity is subject to availability and specific conditions.

14. Hours. Use is within opening hours and per membership. The Club may modify hours, guided activities or services for technical, organisational, maintenance, safety or force-majeure reasons, communicating it by the usual means.

15. Closure for maintenance. The Club may close all or part of the facilities for maintenance, repair, refurbishment, cleaning, improvement, health, technical or force-majeure reasons, giving reasonable notice where possible.

16. Diligent use. The User must use facilities, equipment, lockers, changing rooms, wet areas and other spaces correctly and respectfully, following staff instructions, signage and applicable rules.

17. Coexistence and respect. Bothersome, violent, intimidating, discriminatory or disrespectful conduct, shouting, harassment, disorder or misuse affecting others' rest, safety, privacy or enjoyment is not allowed.

18. Clothing and hygiene. Appropriate sports clothing and footwear are required for each area; street clothes, inadequate footwear, flip-flops where not allowed, or bare chest are not permitted in sports areas except where expressly allowed.

19. General prohibitions. Throughout the Club, unless expressly authorised, it is prohibited to:

  • Smoke, vape or consume non-permitted substances.
  • Enter barefoot, bare-chested or inappropriately dressed outside permitted areas.
  • Bring glass containers into sports areas, changing rooms, pool or wet areas.
  • Eat in changing rooms, wet areas, sports rooms or non-designated spaces.
  • Enter with animals, except assistance dogs or other legally permitted cases.
  • Record or photograph other users or staff without authorisation.
  • Use equipment without following technical or safety instructions.
  • Tamper with equipment, HVAC, sound, lighting, access or safety elements without authorisation.

04Lockers, Belongings and Changing Rooms

20. Daily-use lockers. Available subject to availability, activated with a code the user provides; the user is solely responsible for loss/theft from not closing lockers properly. Daily lockers must be emptied on leaving.

21. Removal of belongings. The Club may open lockers and remove items for misuse, daily lockers left with belongings, end/non-payment of rental, cancellation, unauthorised padlocks, or safety, hygiene, emergency or breach reasons.

22. Custody and recovery. Lockers are emptied nightly; items go to lost-and-found and are kept a maximum of 7 calendar days, after which unclaimed items may be handled per internal protocols (except valuables/documents).

23. Personal belongings. The Club is not liable for loss, theft, deterioration or forgetting of items except where legally attributable to it. Do not leave valuables in changing rooms, lockers, rooms, common areas or vehicles.

24. Changing-room and wet-area rules. It is mandatory to:

  • Wear flip-flops in showers, pool and wet areas.
  • Use a towel and, where applicable, swimwear or required equipment.
  • Not eat in changing rooms or wet areas.
  • Not shave, dye or wax where it affects hygiene, except in designated areas.
  • Not use soaps, creams or oils where prohibited, nor enter wet areas in street footwear.
  • Not leave lockers closed or belongings inside at daily closing.

05Activity- and Area-Specific Rules

25. Guided activities run per the current schedule, subject to changes, cancellations or substitutions for organisational, technical, minimum-capacity, instructor-availability or force-majeure reasons. Follow the instructor at all times. Bookings are made through the app per its rules.

26. In guided activities a towel is mandatory when using mats, machines or shared material; leave it clean, tidy and in its place.

27. Fitness room. A towel between body and machines/benches is mandatory; use machines per instructions, avoid unsuitable loads, do not occupy machines unnecessarily and return weights, bars, discs and dumbbells to their place.

28. Minors in the fitness room are subject to minimum ages, accompaniment and parental authorisation; unless expressly authorised, minors under 16 may not use fitness equipment without supervision.

29. Pool and water area. Showering before bathing, flip-flops and following lifeguard/staff/sign instructions are mandatory; cap/swimwear where required. Access may be restricted for minors, contagious illnesses or hygiene/safety breaches.

30. Bookings and cancellations must follow the Club's procedure and deadlines; no-shows, late cancellation or misuse may result in penalties, charges, loss of the booking or temporary suspension of the right to book.

31. Invitations. Guest passes/one-off access are subject to conditions, limits, availability, guest identification and rules; the guest must accept the club rules and the inviting member is responsible for correct use.

06Health, Safety and Fitness to Exercise

32. The User declares they have no illness, injury, allergy, impediment or medical contraindication preventing or advising against exercise or use of the contracted facilities.

33. Before exercising or using specific facilities, the User must inform staff of any injury, illness, allergy, pregnancy, medical treatment or limitation that may affect their safety or that of others.

34. The Club recommends periodic medical check-ups and a prior medical test where there are risk factors, advanced age, prolonged inactivity or doubts about fitness.

35. People with an infectious/contagious illness, open wounds, infections or symptoms of a transmissible illness may not use the facilities.

36. The User is responsible for controlled exercise suited to their fitness, age and health, and must stop and seek help on pain, dizziness, abnormal fatigue, breathing difficulty or any warning symptom.

07Liability

37. The Club is not liable for damage from the User's negligence, misuse, disobedience of instructions, failure to disclose injuries, breach of rules or exercise unsuited to their condition.

38. The User is liable for damage caused to the Club, facilities, staff, other users or third parties through intent, fault, negligence, misuse or breach; the Club may claim repair, replacement or compensation.

39. Cameras and security. Security cameras may operate in common areas and accesses (excluding changing rooms, toilets and private areas). Cameras do not make the Club the custodian of the User's belongings.

08Cancellation, Suspension and Leave

40. Voluntary cancellation. Definitive cancellation may be requested at any time, in writing, before the 20th/24th of the prior month; late requests take effect the following period, unless expressly accepted.

41. Effects of cancellation. It ends the contract, loses membership and requires returning the access means if requested. It does NOT entail any refund of amounts already paid in advance (quarterly/half-yearly/annual), nor a proportional refund for unused months.

42. Cancellation for breach. The Club may cancel with immediate effect for serious or repeated breach of these conditions, rules, payment obligations, staff instructions, coexistence/safety/hygiene rules, or fraudulent or transferred use of the membership.

09Communications

43-44. Communications may be by email, phone, SMS, messaging, app, private area, signage, website or corporate social media. The User must keep their personal, contact and bank data updated; the Club is not responsible for non-receipt due to incorrect or outdated data.

45. Commercial communications. The Club may send promotions, events or news where it has a legal basis; the User may object or unsubscribe by the means indicated or by contacting the Club.

10Personal Data Protection

46-47. Controller and purposes. The data controller is BUILD ACTIVITY SL. Data are processed to manage registration, maintenance and cancellation, provide services, manage fees/payments, control access, organise activities, handle queries/incidents, comply with legal obligations, manage security and, where applicable, send commercial communications.

48-49. Legal basis and retention. Processing relies on performance of the contract, legal obligations, the Club's legitimate interest and, where needed, consent. Data are kept during the relationship and for the periods needed for legal, tax, accounting and contractual liabilities.

50-51. Rights. The User may exercise access, rectification, erasure, objection, restriction, portability and, where applicable, withdrawal of consent, by writing to the Club's contact email and proving identity. Additional information is available via the privacy policy, signage, forms or website.

11Image Rights

52-53. The Club may ask for authorisation to use the User's image on its website, social media, promotional videos and media; this is voluntary and may require a separate consent. Accepting these conditions does not by itself authorise promotional use of the image where specific consent is legally required.

12Acceptance

54-56. By accepting, the User declares they have read, understood and accepted these general terms, the particular conditions of their membership, current rates and internal rules. The registration form, particular conditions, current rates, SEPA authorisation, privacy policy and each facility's specific rules form part of the contract. In case of conflict, the particular conditions accepted prevail as to membership, price, duration, included services and specific economic conditions.

57. Signature. In witness of agreement, the parties accept this document on the date indicated. Accepting in the app records your acceptance electronically, with date, version and language.
